1. Liability Waiver (Subject to HKSAR Limitations)
- You acknowledge baseball involves inherent risks (e.g., injury, equipment failure).
- To the fullest extent permitted by law, the academy excludes liability for:
- Death/personal injury caused by negligence (except where statutory liability applies).
- Property damage or economic loss, unless due to our willful misconduct.
- Minors’ participation requires parental/guardian agreement.
2. No Refunds (Permissible Under HKSAR Consumer Law)
- All fees are non-refundable except where:
-The academy cancels a session without offering rescheduling (e.g., due to force majeure).
- A court deems the clause "unconscionable" under Cap. 458.
- Rescheduling: 72-hour notice required; subject to availability (max 1 change per booking).
3. Force Majeure (Typhoons, Pandemics, etc.)
- The academy is not liable for failures or delays caused by events beyond reasonable control, including:
-Natural disasters (e.g., typhoons, floods).
-Government orders (e.g., pandemic restrictions).
-Utility failures, strikes, or civil unrest.
- Affected sessions may be rescheduled or credited (no cash refunds).
4. Binding Contract Formation
Your booking constitutes acceptance of these terms under Hong Kong Contract Law.
5. Safety & Expulsion
- Participants must comply with staff instructions. Non-compliance may lead to expulsion without refund.
- You warrant you have no medical conditions unfit for training.
6. Data & Media (Compliant with PDPO Cap. 486)
- Photos/videos may be used for marketing unless you opt out via email.
- Personal data will be handled per our Privacy Policy (linked).
7. Governing Law & Dispute Resolution
Governed by HKSAR law; disputes resolved via Hong Kong courts or arbitration.
- If any clause is invalid, the rest remain enforceable.
